Terms & Conditions of Sale
1. General
All artworks displayed on the Art Alive Gallery website are subject to availability and confirmation by the Gallery.
Art Alive Gallery reserves the right to refuse or cancel any booking or sale at its sole discretion.
2. Pricing
All prices are subject to change without prior notice.
Applicable GST, TCS, taxes, duties, shipping, insurance, packing, handling, customs, and related charges shall be payable additionally wherever applicable unless specifically stated otherwise.
3. Booking & Advance Payments
An artwork shall be considered reserved only upon receipt of the agreed advance payment or full payment.
Advance payments made toward artwork bookings are non-refundable unless otherwise agreed in writing by the Gallery.
At the sole discretion of the Gallery, a booking amount may be adjusted against another artwork within a limited period and upon mutual agreement.
4. Payment Terms
Full payment must be completed prior to dispatch or delivery of the artwork.
Orders shall be processed only upon receipt of cleared funds.
5. Artwork Information
All dimensions, mediums, descriptions, framing details, and artwork information provided on the website are approximate and subject to minor variation.
Colours and textures of artworks may vary slightly from digital images displayed online due to screen settings, photography, lighting, and material characteristics.
6. Authenticity
All artworks sold by Art Alive Gallery are guaranteed authentic and shall be accompanied, wherever applicable, by an Invoice and Certificate of Authenticity issued by the Gallery and/or artist.
7. Ownership & Intellectual Property
Ownership of the physical artwork transfers to the Buyer only upon receipt of full payment.
Copyright, reproduction rights, and all intellectual property rights relating to the artwork remain solely with the artist and/or copyright holder.
No artwork, image, catalogue content, or website material may be reproduced, published, transmitted, or commercially exploited without prior written permission.
8. Shipping & Delivery
Artworks are dispatched strictly on an “as is” basis in the condition approved by the Buyer.
Delivery timelines are estimates only and may vary depending on destination, customs clearance, logistics providers, or unforeseen circumstances.
Risk and responsibility for the artwork pass to the Buyer upon dispatch/delivery.
The Buyer is advised to inspect the artwork immediately upon receipt.
9. Storage
Purchased artworks may be stored by the Gallery for a limited period upon prior written request and subject to storage terms determined by the Gallery. The Gallery shall not be liable for any deterioration, damage, or loss after the agreed storage period has expired.
10. No Return / No Exchange
All sales are final.
No cancellation, return, exchange, or refund shall be permitted once an artwork has been sold and/or dispatched.
11. Limitation of Liability
Art Alive Gallery shall not be liable for indirect, incidental, consequential, or special damages arising from the purchase, shipment, delay, or use of any artwork.
12. Force Majeure
The Gallery shall not be responsible for delay or failure to perform obligations due to events beyond reasonable control including but not limited to natural disasters, war, government restrictions, transportation disruptions, strikes, pandemics, or acts of God.
13. Website Content
Art Alive Gallery makes reasonable efforts to ensure accuracy of information on this website. However, the Gallery does not warrant that all descriptions, pricing, images, or content are error-free, complete, or current at all times.
14. Governing Law & Jurisdiction
These Terms & Conditions shall be governed by the laws of India. Any dispute arising out of or relating to the purchase, booking, or sale of artworks shall be subject to the exclusive jurisdiction of the courts of Delhi, India.
